Namjera mi je na jednom mjestu opisati važne zakonske obveze pomoraca u RH.

Radi se o poreznoj prijavi, odnosno, obračunu poreza na dohodak te mirovinskom i zdravstvenom osiguranju.

Ako netko nema volje sve čitati i/ili je disleksičar, neka preskoči do UKRATKO.

Ajmo prvo o osiguranju.

Obvezno mirovinsko i zdravstveno osiguranje

 Od 01.01.2008. godine uvedeno je obvezno mirovinsko i zdravstveno osiguranje za svakog pomorca državljanina RH koji plovi na brodu u međunarodnim vodama, neovisno o tome pod čijom je zastavom brod na koji se pomorac ukrcao. Razdoblje osiguranja je vrijeme od dana ukrcaja do dana iskrcaja s broda.

 Za pomorca koji je sklopio ugovor s inozemnim poslodavcem prijavu i odjavu na obvezna osiguranja podnosi lučka kapetanija nadležna prema mjestu njegova prebivališta, i to na temelju pomorske knjižice i dokaza o danima provedenim na plovidbi. EDIT (4/2015): Ovo je trenutno pod upitnikom jer neke lucke kapetanije (LK Rijeka) traze od pomoraca da sami vrse prijave.

 Ako pomorac uzdržava članove obitelji koji nisu zdravstveno osigurani, dužan ih je prijaviti u sustav obveznog zdravstvenog osiguranja. I za članove obitelji pomorca koji je sklopio ugovor s inozemnim poslodavcem prijavu podnosi lučka kapetanija, i to na temelju podataka koje je dostavio pomorac ili posrednik preko kojeg se pomorac zapošljava.

 Za razdoblje od dana ukrcaja do dana iskrcaja s broda pomorci sami za sebe plaćaju doprinose za obvezna osiguranja na temelju rješenja koje će im izdati Porezna uprava nadležna prema mjestu njihova prebivališta.

 Plaća se doprinos za mirovinsko osiguranje od 20% (ili I stup 15% + II stup 5%), doprinos za zdravstveno osiguranje od 15%, te doprinos za osiguranje od nesreće na radu od 0,5%. Osnovice za obračun ovih doprinosa i poreza na dohodak utvrđene su posebnom naredbom o mjesečnoj osnovici za obračun doprinosa za obvezna osiguranja člana posade broda u međunarodnoj plovidbi.  Za 'cruiseraše' je oko 900kn-1300kn mjesečno.   U periodu između ugovora/plovidbe (dok ste kod kuće), pomorac nije obvezno prijavljen u sustavima socijalnog osiguranja, ali može se sam prijaviti (to bi svi trebali napraviti ako niste zaposleni u tom periodu). U mirovinskom osiguranju može upotrebljavati institut produljenog osiguranja i sam za sebe plaćati doprinos na najnižu mjesečnu osnovicu propisanu zakonom (minimalac), što je mjesečni izdatak za mirovinsko osiguranje od cca. 460kn. U sustavu zdravstvenog osiguranja, za razdoblje između dvije plovidbe, prava se ostvaruju prijavom nadležnoj službi u propisanom roku, pa je dovoljno da se pomorac u roku od 30 dana od prestanka obveznog osiguranja prijavi nadležnoj službi HZZO-a da bi i u razdoblju dok ne plovi zadržao status osiguranika bez obveze plaćanja doprinosa.Za članove obitelji pomorca koji su preko njega zdravstveno osigurani pomorac plaća doprinos za osnovno zdravstveno osiguranje na najnižu osnovicu, tako da mu je mjesečna obveza za svakog člana obitelji oko 370 kuna.

 Rezimirat ću to sve na kraju, onako, zdravo-seljački, kratko i jasno u koracima, što se sve treba napraviti i kako.

Ajmo sad na porez na dohodak! Njemu se svi vesele!

Godišnji porez na dohodak

Dohodak pomoraca oporezuje se kao plaća tj. dohodak od nesamostalnog rada.
Obvezu podnošenja godišnje porezne prijave poreza na dohodak za pomorce regulira (između ostalih zakona i pravilnika) Pomorski zakonik, koji kaže:

- pomorci koji su tijekom kalendarske godine u plovidbi proveli ukupno manje od 183 dana, dužni su podnijeti godišnju prijavu poreza na dohodak.

- pomorci koji su tijekom kalendarske godine u plovidbi proveli ukupno 183 dana i više, nisu dužni podnositi poreznu prijavu. Oni to mogu napraviti svojom voljom. (Ovo VIŠE NE VRIJEDI. SVI pomorci, bez obzira na broj dana plovidbe, DUŽNI SU podnijeti poreznu prijavu: Uputa Porezne uprave)

 Podnošenjem godišnje prijave poreza na dohodak, pomorac ostvaruje pravo na sve porezne olakšice kao i drugi obveznici poreza na dohodak, ali i jednu dodatnu. Za svaki dan koji je proveo na brodu porezna mu se osnovica smanjuje za svotu dnevnoga pomorskog dodatka, neovisno o tome da li mu se isplaćivao pomorski dodatak. Pomorski je dodatak trenutačno propisan u svoti od 400 kuna na dan (Pravilnik o porezu na dohodak - čl.13. toč.18), što znači da bi se npr. pomorcu koji je na brodu proveo 150 dana porezna osnovica za tu kalendarsku godinu smanjila za dodatnih 60.000 kuna. (Udruga pomoraca Hrvatske: http://www.pomorac.net/ - uputila je 13 zahtjeva Vladi RH, a jedan od njih je i povećanje pomorskog dodatka sa 400Kn na 1800Kn dnevno. LINK. Tajnik Sindikata Pomoraca Hrvatske, g. Brazzoduro, na svom blogu je također objavio prijedlog izmjena i dopuna Pomorskog zakonika, u kojem traži i povećanje pomorskog dodatka - LINK)

 Naravno, ukoliko IMATE 183 DANA PLOVIDBE, OSLOBOĐENI STE plaćanja poreza na dohodak. Dodatno, ukoliko imate više od 183 dana plovidbe, razlika se može prenositi u sljedeću godinu. U dane plovidbe vam se računa i vrijeme na putu do broda/s broda, dani edukacije u inozemstvu te liječenja. (Predlažu se i još neke izmjene da se priznaju i dani edukacije u RH.)

 Znači ovako. Za godišnju poreznu prijavu poreza na dohodak, uz one EPOM i DOH obrasce, morate priložiti i DPOM Obrazac koji vam izdaje nadležna lučka kapetanija, a u njemu piše koliko ste ostvarili dana plovidbe u poreznom razdoblju.

UKRATKO

Sukladno najavi, evo skraćene verzije u četiri koraka.

1. PRIJE ukrcaja, potrebno je javiti se u nadležnu Lučku kapetaniju sa matrikulom, kopijom ugovora i kopijom avio-karte (prijavljuje vas agent/ovlašteni predstavnik/opunomoćenik ili vi sami). To je potrebno da vam odrede osnovicu za plaćanje doprinosa mirovinskog i zdravstenog osiguranja (sukladno Naredbi) te vam izvrše prijavu u mirovinsko i zdravstveno, a vaša draga lokalna porezna uprava vam onda (možda ili kasno) pošalje uplatnice na kućnu adresu. Također na osnovu ugovora i avio-karte vas upišu za DPOM, odnosno, kad ste krenuli na brod. (Informacija o socijalnoj reformi za pomorce: IV-1.)
Primjera radi, sukladno Naredbi, ako ste 'mladić sobe' onda plaćate samo 960Kn/mj za doprinose, jer ne računaju napojnice u cashu. Za djevojke ne piše.  ;)

2. PRIJE iskrcaja, OBAVEZNO tražiti na brodu da vam stave žig u matrikulu kad ste se ukrcali, iskrcali i u kojem svojstvu. S takvom matrikulom, javiti se nadleznoj Lučkoj kapetaniji da bi vam mogli izdati na kraju godine DPOM obrazac.

3. Dok ste u LK, popunite/tražite zahtjev za priznanje osiguranika po osnovi produženog mirovinskog osiguranja (onih 460kn) te zahtjev za zdravstveno osiguranje po osnovi privremene nezaposlenosti ili privremene nesposobnosti za rad. (Informacija o socijalnoj reformi za pomorce: IV-3.)

4. Do kraja veljače tekuće godine, potrebno je podnijeti godišnju prijavu poreza na dohodak za prethodnu godinu nadležnoj poreznoj upravi. Za to će vam onda trebati onaj DPOM obrazac od lučke kapetanije. Ako ste skupili 183 dana plovidbe, uključujući putovanja na brod/s broda, edukacije u inozemstvu i liječenja, a nemate dodatnih prihoda, potrebno je samo popuniti osnovne podatke tipa: ime, prezime, adresa, OIB te priložiti DPOM sa danima plovidbe i to je to. Ako nemate 183 dana i/ili imate nekih drugih prihoda koji podliježu oporezivanju, onda morate popuniti prijavu s upisanim prihodima, a ukoliko niste vješti popunjavanju porezne prijave i računanju, može vam to napraviti bilo koji knjigovodstveni servis (ili prijatelj/ica, rodbina u poreznoj, ...). Kao jedinstvenu uslugu za te poslove pomoraca nudi Pomorski Servis Nautičkog Centra (ovi gdje ste polagali za brevete, odnosno, za D1). Adresa: http://www.nc-pomorski-servis.com/, oni te sve poslove cijene (mislim) 950kn godišnje. Predlažem da se raspitate. EDIT (4/2015): Trebat ce vam i dokaz o primicima (kopije uplata/ugovora/...), popunjen EPOM te i popunjena izjava o visini primanja u prethodnoj godini.

Dakle, ako ste u gabuli i nemate 183 dana, za umanjenje osnovice za plaćanje poreza na dohodak priznaje vam se pomorski dodatak, osobni odbitak (osnovni, bez olakšica iznosi 21,600Kn), sve uplate doprinosa obveznog osiguranja te ostali priznati porezni odbici i olakšice (uzdržavani članovi, ortopedska i seksualna pomagala, kupovina prve nekretnine ili adaptacija te donacije vladajućoj stranci - izbacite uljeze).

Dodatno, nadati se možemo usvajanju prijedloga za uvođenje beneficiranog radnog staža za pomorce koji je sad aktualan te povećanju dnevnog pomorskog dodatka tako da plaćamo manje poreza.

Ponajprije, želim pozdraviti zaposlenike poduzeća Uspinjača Posao d.o.o.

Moram se pohvaliti da sam jučer prvi put bio u agenciji.
Evo je i na popisu: mmpi.hr-popis pravnih osoba

Naime, došao sam po Certificate of Employment koji mi treba za aplikaciju za vizu.
Prilikom 'primopredaje' dokumenta saznao sam da njihova 'usluga' košta 200€, a za koju ne mogu dobiti račun već trebam dati gotovinu kao najveća naivčina.
Rekao sam da sam potpisao izjavu i poslao poslodavcu u kojoj stoji da ne smijem ništa platiti posredniku. "Nema to veze s ovim.", bio je nadahnuti odgovor za budale.
Kad sam rekao da je to protuzakonito po čl. 14. i 15. Pravilnika o posredovanju pri zapošljavanju pomoraca i da hoću račun na kojem piše "Naknada za posredovanje u zapošljavanju" ako misle da im platim. Rekli su da niti račun niti potvrdu niti uplatnicu neću dobiti te da ja to zapravo ne moram platiti, ali su insinuirali da bi bilo bolje da ja to platim te popratili riječima "Ako razumijete što želim reći." - ne razumijem, objasnite mi pismeno, molim Vas (i potpišite).
Argumentirano sa draguljima poput: "Mi nismo posrednik, mi smo agencija pa se taj pravilnik ne odnosi na nas" (briljantno tumačenje zakona - najvjerovatnije zbog takvih vrsnih pravnih umova im je već i bila oduzeta dopusnica za rad) ili "Mi smo Vama učinili uslugu (koju će im itekako dobro platiti poslodavac) pa od Vas očekujemo i da nam to (protuzakonito) i platite, a mi Vam nećemo izdati račun."

Sljedeći dan, pokušaj sporazumijevanja sa smozvanim "managerom" je također neslavno završio.
Čovjek koji nikad nije studirao niti proučavao logiku, ne treba ju pokušavati koristiti kao alat u pregovaranju, već izbjegavati na svaki mogući način jer se primjeti.

"Ja ovo radim 20 godina", "Vi mislite da ste Vi veći od nas" (možda je mislio na genitalije? stvarno ne znam o kakvoj mjeri i kriterijima se radi), "samo se Vi držite Vaših principa" (principa? gospodin je najvjerovatnije htio reći "Zakona" - kojih se ja kao građanin RH i držim i pozivam sve koji ovo čitaju da se i oni njih drže i ne sudjeluju svjesno u protuzakonitim radnjama utaje poreza, između ostalog).
"Pišite Vi po Internetu što god želite" - hoću.

Moj savjet svima je: ne plaćajte im ništa, plaćaju im to vaši poslodavci, a i protuzakonito je.
Ako vam hoće naplatiti nešto po 'cjeniku', recite im da cjenik prvo objave na internet stranice.
Ako im je to malo, neka traže drugi posao i prouče izraz "poslovni rizik".
Dok im god budete plaćali gotovinom bez računa do tad će to i raditi jer naše službe tu ne mogu ništa bez nekih dokaza.

1.     Responsible for the safe, efficient and cost effective operation and maintenance of electrical machinery and equipment on board through the use of good electrical and engineering practice.         

2.     Responsible for the maintenance of Medium Voltage Switchgear, Navigational Aids, PLC Control & Automation Systems, Communications and Entertainment Systems on a modern Cruise Ship.         

3.     Under the direction of the 1st Electro-Technical Officer, will trouble shoot problems and complete repairs in compliance with safe working practices and good engineering principles.         

4.     Maintenance and repair of ship's elevators ensuring that all work is carried out in accordance with all relevant safety standards and Fleet Instructions         

5.     Service maintenance, repairs and fault finding of the onboard fire detection system. To ensure that all faulty equipment is landed in compliance with current environmental policies and stocks are readily maintained.         

6.     Monitoring of cathodic protection systems for the hull and all swimming pools onboard ensuring that all daily and weekly cathodic protection readings are accurately recorded and maintained         

7.     Responsible for safe working operation, repairs and fault finding of accommodation ladders, baggage doors, shell doors and tender platforms ensuring that all work is carried out in accordance with relevant safety standards and Fleet Instructions         

8.     Responsible for the organization of electrical stores and stock control for electrical consumables and tools. To ensure that the electrical workshop is kept clean and that all tools are returned complete after use         

9.     Be aware of, and actively participate in, the safety responsibilities associated with this position.       

10.     Uphold and maintain by example, at all times, all aspects of the customer care programme for the associated brand.  Ensure all staff under his/her supervision are fully trained in and practice the principles of the program, producing the highest level of passenger/crew service.

Assistant Systems Manager

POSITION SUMMARY

The Assistant Systems Manager’s primary responsibility is to assist the Ship Systems Manager in maintaining all IT systems and equipment onboard. The Assistant Systems Manager works closely with the Ship Systems Manager, Manager of Ship Systems, and IT Technical Support department personnel at the corporate office to maintain hardware, software, cabling systems, networks, and resolve other technical issues.

ESSENTIAL FUNCTIONS

Performs daily, voyage, and monthly operations as detailed in run books and related documents.
Supports all shipboard users to keep workstations in working condition, including PC workstations, point-of-sale terminals, cabling systems, servers, and related hardware.
User requests will be responded to promptly 24 hours per day, 7 days per week.
Provides basic training support to users in use of common desktop software and specialized property management software.
Takes direction from Systems Manager as to division of responsibilities and assignments.
Will keep onboard management informed of any IT issues and policies that affect shipboard operations in their areas of responsibility.
Follow directives of onboard management to adhere to all behavioral, safety and other rules for crew members.
Must be familiar with the Safety and Environmental Protection Policy and the SEMS, and carry out the policies and procedures appropriate for his/her position.
DIMENSIONS

General support of systems and procedural activities in 25+ departments with nearly 200 users onboard the vessel.

NATURE AND SCOPE

Reports directly to the Systems Manager for work related issues. Reports to the Staff Captain for ship rules and other ship specific issues. Works closely with Ship Systems Manager, Manager of Ship Systems and IT Technical Support Department personnel at corporate office to maintain hardware, cabling systems, networks, software and other technical issues.

QUALIFICATIONS, EDUCATION AND ATTRIBUTES

Must have some formal training in related IT hardware and software and at least one years of practical experience dealing with IT systems with direct contact with application users, operation experience and systems administration.QUALIFICATIONS
Excellent written and verbal skills in English
In-depth knowledge of systems/programs
Experience in support of Microsoft Exchange, Microsoft Office, Windows XP Pro, Windows Server 2003, Windows 2000 (Professional & Server), troubleshooting and break-fix of PC and printer hardware.
Prior experience with hotel property management and point-of-sale systems a plus
EDUCATION

Associates Degree in Computer Science or equivalent experience
A+ and Network+ Certification is preffered

PHYSICAL REQUIREMENTS

While performing the essential functions of this job, all team members are required to stand; walk long distances on the ship; use hands to touch, handle or feel; reach with hands and arms; talk or hear and taste or smell. All vessel positions require repetitive motion of bending, climbing, going up and down stairs and lifting more than 25 pounds. This job requires specific vision abilities to include close vision, distance vision, color vision, peripheral vision, depth perception and ability to adjust focus.
All team members must be physically able to participate in emergency life saving procedures and drills. All vessel positions require full use and range of arms and legs as well as full visual, verbal and hearing abilities to receive and give instructions in the event of an emergency including the lowering of lifeboats.
Work within different temperature changes—indoors to outdoors.
Able to pass basic safety course.

Svim članovima foruma koji su sad na brodu blizu američke istočne obale želim sve najbolje te da ih promaše uragan Earl i tropska oluja Fiona.

Zamolio bih i veterane da nam opišu malo iskustva (ako su ih imali) sa tropskim olujama i uraganima.

Što se dogodilo, da li je brod promijenio rutu, što s gostima i sl.

Ako je netko radio na nekom otoku tipa Castaway Cay ili u Dominikanskoj Republici za vrijeme oluja, neka nam opiše malo iskustva.

Znam da imamo i novih članova koji idu na otočne pozicije pa sam siguran da i njih to zanima jer mi balkanci baš i nismo navikli na takve vremenske uvjete. :)

Maintain and support shipboard computer systems so that business users are able to effective utilize the systems in their respective jobs. Manage servers, including file & print, messaging, database and application servers and their associated operating systems and software. Manage security solutions, including firewalls, anti-virus, anti-malware, intrusion detection systems and user policies. Manage all network hardware and equipment, including routers, switches, hubs, Wireless Access Points and UPSs. Recommend, schedule, and perform network improvements, upgrades, and repairs. Ensure satellite network connectivity whenever possible, monitor the status of the satellite equipment and liaise with vendors for upgrades, installs, modifications and servicing. Ensure correct functioning of all satellite telephonic/fax connections and facilities. Administration of all I.T. equipment including installing, configuring, maintaining and troubleshooting of end user workstation hardware, software and peripheral devices. Troubleshoot and resolve end-user hardware and software computer problems in a timely and accurate fashion. Provide end user application task assistance where there is a reasonable requirement. Monitor network performance, perform network design and capacity planning and provide performance statistics and reports – LAN and WAN. Conduct research on network products, services, protocols, and standards in support of network procurement and development efforts. Interact and negotiate with vendors, outsourcers, and contractors to secure network products and services. Develop, implement and maintain policies, procedures and associated Training plans for network resource administration, appropriate use, and disaster recovery. Manage system data backups and recovery. Support or provide guidance to other members of the IT team. Upgrade equipment, hardware and software, where necessary to ensure all systems are kept up-to-date with published standards and recommendations. Provide 2nd-line support to the Entertainment Department for the passenger CyberCafé and WiFi users. Assist Chief Electrician with troubleshooting and support of the PABX.
